1. About DrinkSight

DrinkSight is a research and insights service operated by Wilde Toast Ltd (“DrinkSight”, “Wilde Toast”, “we”, “us” or “our”).

These Terms & Conditions apply to your use of the DrinkSight website, your membership of the DrinkSight research panel and your participation in research conducted by DrinkSight.

By using our website, joining the DrinkSight panel or participating in our research, you agree to these Terms & Conditions.

Wilde Toast Ltd is a company registered in England and Wales.

2. The DrinkSight panel

The DrinkSight panel brings together professionals working within the drinks, hospitality and on-trade industries to contribute their experience and opinions to industry research.

Joining the panel does not guarantee that you will be invited to participate in research.

Research opportunities may be offered based on factors such as your role, experience, location, type of venue or other criteria relevant to a particular project.

We may decide who is eligible to participate in individual research projects.

3. Eligibility

You must be at least 18 years old to join the DrinkSight panel or participate in paid DrinkSight research.

When joining the panel or participating in research, you agree to provide information that is accurate and truthful to the best of your knowledge.

You must not impersonate another person, create multiple identities or provide deliberately false information in order to qualify for research or receive additional incentives.

We reserve the right to verify that participants meet the eligibility requirements for a particular research project.

4. Participating in research

Participation in DrinkSight research is voluntary.

Research may include surveys, interviews, discussions, online research, video calls or other research methods.

When participating, we ask that you provide genuine responses based on your own professional experience, knowledge and opinions. Use of AI to generate responses is not permitted.

Where a particular project has additional requirements, we will explain these before or during the research.

You may choose not to answer a question or stop participating in research at any time, although this may affect your eligibility for an incentive where completion of the research is a stated requirement.

5. Quality of research responses

The value of DrinkSight research depends on the quality and authenticity of responses from participants.

We may carry out reasonable quality checks on research responses.

We reserve the right to reject responses or withhold an incentive where there is reasonable evidence that a participant has:

  • provided deliberately false or misleading information;
  • completed research multiple times when only one response is permitted;
  • provided responses that do not reasonably engage with the questions asked;
  • used automated systems, AI, bots or other methods to generate responses where this has not been permitted;
  • misrepresented their professional role or experience;
  • attempted to manipulate eligibility requirements; or
  • otherwise acted fraudulently or abused the research process.

Where appropriate, we may also remove a participant from the DrinkSight panel.

6. Research incentives and rewards

Some DrinkSight research projects may offer a payment, voucher, product or other reward for participation.

The incentive and any eligibility requirements will normally be explained when you are invited to participate.

Unless otherwise stated, an incentive is provided in return for successfully completing the relevant research and meeting the stated eligibility and quality requirements.

Incentives may vary between research projects and participants.

Where an incentive is provided through a third-party supplier, additional terms from that supplier may apply.

We will aim to provide incentives within the timeframe communicated for the relevant project, although processing times may occasionally vary.

You are responsible for any personal tax obligations that may arise from incentives or payments you receive.

7. Your research responses

By participating in DrinkSight research, you give us permission to analyse and use the responses and information you provide for research and insight purposes.

This may include using your responses to produce:

  • research reports;
  • presentations;
  • dashboards and data products;
  • industry analysis;
  • articles and thought leadership;
  • aggregated datasets;
  • client research and consultancy; and
  • other DrinkSight insight products and services.

We may combine your responses with information from other participants to identify trends, themes and patterns.

Where appropriate, research findings provided externally will be aggregated or anonymised so that individual participants cannot reasonably be identified.

We may use anonymised comments or quotations from research responses in our reports and other outputs.

We will not publicly attribute a quote or research response to you personally without making this clear to you and obtaining any permission required.

Our handling of personal information is explained in our Privacy Policy.

8. Ownership of DrinkSight research and intellectual property

DrinkSight and Wilde Toast own, or have the right to use, the intellectual property associated with the DrinkSight service and its research products.

This includes, where applicable, our research methodologies, questionnaires, reports, analysis, datasets, dashboards, graphics, branding, website content and other materials produced by us.

Participation in DrinkSight research does not give you ownership of the resulting research, datasets, reports or other outputs.

You retain ownership of any intellectual property that you already owned before providing it to us.

By submitting research responses, you grant Wilde Toast Ltd a worldwide, royalty-free right to use, analyse, reproduce, adapt, aggregate and anonymise those responses for the purposes of operating DrinkSight and creating research, analysis and insight products.

9. Confidential research

From time to time, you may be invited to participate in research involving information that has not been made public.

Where we tell you that research or information is confidential, you agree not to share, publish, photograph, reproduce or otherwise disclose that information without our permission.

This may include information about new products, concepts, campaigns, packaging, pricing, strategies or other commercially sensitive information belonging to DrinkSight or our clients.

Additional confidentiality terms may apply to particular projects.

10. Use of the DrinkSight website

You may use the DrinkSight website for lawful purposes only.

You must not:

  • attempt to gain unauthorised access to the website or our systems;
  • interfere with the operation or security of the website;
  • introduce viruses, malicious software or other harmful material;
  • scrape, systematically extract or reproduce DrinkSight content without permission;
  • use our website or research materials for fraudulent purposes; or
  • copy or commercially exploit DrinkSight content without our permission.

Unless otherwise stated, the content available through DrinkSight is owned by or licensed to Wilde Toast Ltd.

You may view and use publicly available content for your own personal or professional reference.

You may not reproduce, sell, license, commercially exploit or create substantial derivative datasets from DrinkSight content without our written permission.

12. Research and insights disclaimer

DrinkSight research reflects the information, experiences and opinions provided by research participants and the data available to us at the relevant time.

While we take reasonable steps to maintain the quality of our research, we cannot guarantee that every participant response is complete or accurate.

Research findings are intended to provide insight and should not be treated as a guarantee of future market performance, consumer behaviour or commercial outcomes.

You should use your own judgement when making business or commercial decisions based on DrinkSight content or research.

13. Third-party websites and services

Our website or research may contain links to websites or services operated by third parties.

We are not responsible for the content, availability or privacy practices of third-party websites or services.

Your use of third-party services may be subject to their own terms and privacy policies.

14. Leaving the DrinkSight panel

You can ask to leave the DrinkSight panel at any time.

Once you leave, we will stop inviting you to future research, subject to any administrative communications necessary to complete research or incentives already in progress.

Our treatment of existing research responses and personal information is explained in our Privacy Policy.

15. Suspension or removal from the panel

We may suspend or remove someone from the DrinkSight panel where we reasonably believe they have:

  • breached these Terms & Conditions;
  • provided false or misleading information;
  • attempted to manipulate research or incentive systems;
  • repeatedly provided poor-quality or fraudulent responses;
  • behaved abusively towards DrinkSight staff, researchers or other participants; or
  • otherwise acted in a way that could compromise the integrity of DrinkSight research.

We may also close or change the panel or stop offering research opportunities at our discretion.

16. Availability of DrinkSight

We aim to keep DrinkSight available and operating effectively, but we do not guarantee that the website, panel or any particular research opportunity will always be available.

We may change, suspend or discontinue parts of DrinkSight from time to time.

17. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

To the extent permitted by law, Wilde Toast Ltd will not be responsible for indirect or consequential losses arising from your use of the DrinkSight website or participation in the DrinkSight panel.

Nothing on DrinkSight constitutes financial, legal, investment or other professional advice.

18. Privacy

Your privacy is important to us.

Our Privacy Policy explains what personal information we collect, how we use it, who we may share it with and the rights you have in relation to your information.

By using DrinkSight or participating in our research, you acknowledge that your personal information will be handled as described in our Privacy Policy.

19. Changes to these Terms

We may update these Terms & Conditions from time to time to reflect changes to DrinkSight, our research activities or applicable law.

The latest version will be published on this page and the date at the top will show when it was most recently updated.

If we make significant changes affecting panel members, we may also notify you directly where appropriate.

20. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes relating to these Terms will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights you may have under applicable law.
